• Acceptance of Terms
  Welcome to CardsStar! These Terms of Use ("Terms") govern your access to and use of the CardsStar website and any related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Services.
• Eligibility
  You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Services on behalf of an entity, you represent and warrant that you have the authority to bind that entity to these Terms.
• Account Registration
  To access certain features of the Services, you may be required to create an account. When you create an account, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for any activities that occur under your account. You agree to notify CardsStar immediately of any unauthorized use of your account or any other breach of security. CardsStar will not be liable for any loss or damage arising from your failure to comply with this section.
• Use of the Services
  You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not:
  • Use the Services in any manner that violates any applicable law or regulation.
  • Interfere with or disrupt the Services or servers or networks connected to the Services.
  • Use any data mining, robots, or similar data gathering and extraction methods in connection with the Services.
  • Upload, post, or otherwise transmit any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Upload, post, or otherwise transmit any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
• Intellectual Property
  The Services and all content and materials available on the Services, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, are the property of CardsStar or its content suppliers and are protected by Indian and international copyright laws. You may not modify, reproduce, distribute, create derivative works or adaptations of, publicly display or in any way exploit any of the content in whole or in part except as expressly authorized by CardsStar.
• User Content
  You grant CardsStar a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display any content you upload, post, or otherwise transmit on or through the Services ("User Content") throughout the world in any media. You represent and warrant that you own or control all rights in and to your User Content and that your User Content does not infringe upon the rights of any third party.
• Disclaimer of Warranties
  The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement. CardsStar does not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that defects will be corrected. You acknowledge that your use of the Services is at your sole risk.
• Limitation of Liability
  In no event will CardsStar, its affiliates, or their respective officers, directors, employees, or agents be liable to you or any third party for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with these Terms or the use or inability to use the Services, even if CardsStar has been advised of the possibility of such damages.
• Indemnification
  You agree to indemnify and hold harmless CardsStar, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) incurred directly or indirectly as a result of your violation or breach of these Terms.
• Termination
  CardsStar may terminate or suspend your access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason and without limitation, including but not limited to a breach of these Terms. Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
• Governing Law
  These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.
• Dispute Resolution
  Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be in India. The language of the arbitration shall be English.
• Miscellaneous
  These Terms constitute the entire agreement between you and CardsStar regarding the use of the Services. The failure of CardsStar to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. You may not assign these Terms without the prior written consent of CardsStar. CardsStar may assign these Terms without restriction.
